"Justice Kagan covertly references Tommy Tutone's '80s hit 'Jenny' on p.2 of #SCOTUS opinion."

Tweets Ted Frank, via Throwing Things.

Here's the opinion (PDF):
Under that contract, a company may transport cargo at the Port in exchange for complying with various requirements. The two directly at issue here compel the company to (1) affix a placard on each truck with a phone number for reporting environmental or safety concerns (You’ve seen the type: “How am I driving? 213–867–5309”) and (2) submit a plan listing off-street parking locations for each truck when not in service.
Here's the song.

Interesting she would use a Los Angeles area code.

Beechwood 4-5789, you can call me up and have a date, any old time.

The Orlons.

I love that song! Best stalker song ever. And it's such a sweet stalker song. You kinda like that poor damn stalker.

Just can't get that number out of my head!

Kudos to Kagan.

Oh, no, not The Orlons, The Marvellettes.

I think Tommy Tutone was an L.A. band, actually.

But if you do call Beechwood 4-5789, Don't Hang Up.

I'm getting my telephone songs from 1962 mixed up.

The pissed off the Buffalo chief of police, apparently.

What makes that song so brilliant is that it's 3 minutes of pure sexual obsession. Without being dirty at all!

And I'm not sure if the chorus is supposed to be all the men in the world who want Jenny, or all the voices in his head.

Most messed up and subliminally dangerous catchy pop tune ever!

I suppose the great and mighty have to find a way to amuse themselves (and us) while they go about the dreary business of churning out judicial opinions.

OK so what are the odds that came from Justice Kagan or from someone on her staff? I don't want her getting full cred for someone else's idea, this is not like a legal opinion.

I remember getting a girl's phone number at the end of the night at some club back in the day.

You guessed it, 867-5309. I was pissed off. Not at the deception, but that it took me so long to recognize it. At least I didn't call it.

I remember them looking for Tommy Tutone in one of those VH1 shows. They find him working as a computer programmer or something.

Rikki, don't lose that number.

"I tried my imagination, but I was disturbed."

Was he disturbed like Phoebe Cates walking in on him?

Or is he disturbed like Green Day? He's so messed up he can't even masturbate. Poor, poor stalker.

Hey, at least your tempo is upbeat!

Nah, it's quite upfront about it. You want a creepy stalker tune disguised as a catchy love song? You gotta go with "Every Breath You Take" by the Police

Back in the days of two-letter exchanges, Big Joe Turner had a song that mentioned the number "Cherry I-8-1-2". Too bad about the extra letter and missing digits.

Rudy Protrudi, whoever he is, took a perfectly pleasant Patsy Cline song, "Walking after Midnight", and made it seriously creepy by changing one word:

"I go out stalking after midnight
Out in the moonlight just like we used to do
I'm always stalking after midnight searching for you
I walk for miles along the highway
Well that's just my way of saying I love you
I'm always stalking after midnight searching for you", and so on.

Actually, I thought Every Breath You Take was the best stalker song.

Weird that a 213 area code gets transferred to a nevada corporation.
